Casewyze Terms of Service

PLEASE READ THESE TERMS CAREFULLY. THEY GOVERN YOUR ACCESS TO AND USE OF THE CASEWYZE PLATFORM AND CONTAIN IMPORTANT INFORMATION REGARDING YOUR LEGAL RIGHTS, DISCLAIMERS, LIMITATIONS OF LIABILITY, DATA RESPONSIBILITIES, AND DISPUTE RESOLUTION REQUIREMENTS.

These Terms of Service (“Terms”) form a legally binding agreement between you and CaseWyze (“CaseWyze,” “Company,” “we,” “our,” or “us”) regarding your use of the CaseWyze platform, websites, applications, APIs, mobile applications, integrations, and related services (collectively, the “Services”).

By creating an account, accessing, subscribing to, or using the Services, you agree to these Terms on behalf of yourself and any organization you represent. If you are using the Services on behalf of a company, agency, investigative firm, law office, insurer, vendor, or other entity, you represent and warrant that you have authority to bind that entity to these Terms.

If you do not agree to these Terms, you must discontinue use of the Services immediately.

1. About Casewyze

CaseWyze provides cloud-based investigative case management software and related tools designed to assist investigative agencies, private investigators, legal support professionals, insurance professionals, corporate security departments, vendors, and related organizations with case organization, workflow management, reporting, communications, file management, evidence organization, billing, and operational administration.

The Services may include:

  • Web applications;
  • Mobile applications;
  • APIs and integrations;
  • File storage and uploads;
  • Reporting systems;
  • Notification systems;
  • Artificial intelligence features;
  • Evidence management features;
  • Audit logging;
  • User and permission management;
  • Communication tools;
  • Media processing utilities.

CaseWyze may add, remove, modify, suspend, or discontinue features at any time.

2. Eligibility and Authorized Use

You may use the Services only if:

  • You are legally capable of entering into binding agreements;
  • Your use complies with all applicable laws and regulations;
  • You are authorized to use the Services on behalf of your organization.

You are solely responsible for ensuring that your use of the Services complies with:

  • Federal law;
  • State law;
  • Local law;
  • Licensing regulations;
  • Privacy laws;
  • Data protection laws;
  • Professional ethical obligations;
  • Court orders;
  • Industry-specific restrictions.

CaseWyze does not provide legal advice and does not guarantee that use of the Services satisfies any regulatory or licensing requirement.

3. Investigative and Legal Compliance Responsibilities

You acknowledge that the Services may be used to store sensitive investigative information, evidence, personally identifiable information, surveillance materials, legal documents, communications, and other regulated or confidential records.

You are solely responsible for:

  • Ensuring lawful collection of information;
  • Obtaining required permissions or authorizations;
  • Compliance with investigative licensing laws;
  • Compliance with privacy and surveillance laws;
  • Compliance with evidence handling requirements;
  • Compliance with subpoena and discovery obligations;
  • Compliance with data retention requirements;
  • Compliance with attorney-client confidentiality obligations;
  • Compliance with insurance or healthcare privacy obligations where applicable.

CaseWyze is not responsible for:

  • The legality of information collected by users;
  • User misuse of data;
  • Improper disclosure of evidence or records;
  • Discovery violations;
  • Improper surveillance practices;
  • Failure to preserve evidence;
  • User-generated reports or conclusions.

4. Account Registration

You must provide accurate and current information when registering for the Services.

You are responsible for:

  • Maintaining the confidentiality of login credentials;
  • Managing user access;
  • Configuring user roles and permissions;
  • Restricting unauthorized access;
  • Monitoring account activity.

Each user must maintain a separate login account. Shared accounts are prohibited.

CaseWyze strongly recommends:

  • Multi-factor authentication;
  • Strong password policies;
  • Periodic credential rotation;
  • Immediate disabling of former employee accounts.

You are fully responsible for all activity occurring under your account.

5. Acceptable Use

You agree not to:

  • Use the Services for unlawful purposes;
  • Upload illegal materials;
  • Upload malicious code or malware;
  • Attempt unauthorized access;
  • Circumvent security protections;
  • Reverse engineer the Services;
  • Scrape or harvest data;
  • Interfere with platform operation;
  • Use automated bots without authorization;
  • Misrepresent your identity;
  • Violate third-party rights.

CaseWyze reserves the right to suspend or terminate accounts involved in prohibited activity.

6. Client Data

Ownership

You retain ownership of all data, records, files, reports, media, evidence, notes, communications, and other information uploaded to or created within the Services (“Client Data”).

License to Process Data

You grant CaseWyze a limited license to host, store, process, transmit, organize, back up, and display Client Data solely for purposes of providing the Services.

Responsibility for Data

You are solely responsible for:

  • Accuracy of Client Data;
  • Legality of Client Data;
  • Maintaining backups where necessary;
  • Reviewing exported reports;
  • Controlling user permissions;
  • Managing data retention.

CaseWyze is not responsible for:

  • Inaccurate data;
  • User-generated content;
  • Data entered by third parties;
  • Imported records;
  • User conclusions or investigative findings.

7. Evidence, Media, and File Uploads

You represent and warrant that:

  • You possess all necessary rights to upload materials;
  • Uploaded materials do not violate applicable law;
  • You are authorized to possess and store uploaded evidence.

CaseWyze may report suspected illegal content or unlawful activity to appropriate authorities when required by law or reasonably necessary.

Users are solely responsible for:

  • Chain-of-custody procedures;
  • Preservation requirements;
  • Evidence admissibility;
  • Exporting evidence for litigation or court proceedings.

CaseWyze does not guarantee admissibility of evidence in any legal proceeding.

8. Artificial Intelligence Features

Certain Services may include AI-powered features or integrations utilizing internal or third-party artificial intelligence models.

AI-generated outputs:

  • May contain inaccuracies;
  • May be incomplete;
  • Should not be relied upon as legal advice;
  • Must be independently reviewed by users.

You are solely responsible for verifying all AI-generated content before relying upon or distributing it.

CaseWyze disclaims all liability arising from reliance on AI-generated outputs.

9. Data Security

CaseWyze uses commercially reasonable administrative, technical, and organizational safeguards intended to protect Client Data.

However:

  • No system is completely secure;
  • Internet transmissions cannot be guaranteed secure;
  • Users remain responsible for protecting credentials and exported data.

CaseWyze recommends that users:

  • Use secure networks;
  • Enable multi-factor authentication;
  • Limit access permissions appropriately;
  • Maintain independent backups of critical data.

10. System Availability

CaseWyze strives to maintain reliable system availability but does not guarantee uninterrupted or error-free access.

Services may become unavailable due to:

  • Maintenance;
  • Security incidents;
  • Third-party outages;
  • Infrastructure failures;
  • Force majeure events.

Users are responsible for maintaining independent backups of critical records.

11. Subscriptions and Billing

Certain Services require paid subscriptions.

By subscribing, you agree to:

  • Pay all applicable fees;
  • Maintain valid payment information;
  • Authorize recurring billing where applicable.

Subscription fees may vary based on:

  • User counts;
  • Storage usage;
  • Features;
  • Service tiers.

Failure to pay may result in:

  • Suspension;
  • Restricted access;
  • Termination;
  • Data deletion consistent with these Terms.

Billing disputes must be submitted in writing within thirty (30) days of the disputed charge.

12. Third-Party Services

The Services may integrate with third-party providers, including:

  • Payment processors;
  • Cloud storage providers;
  • Communication providers;
  • AI providers;
  • Mapping services;
  • External APIs.

CaseWyze is not responsible for:

  • Third-party outages;
  • Third-party security failures;
  • Third-party terms or policies;
  • Third-party content or services.

Use of third-party services may be subject to separate agreements.

13. APIs and Integrations

API credentials must be treated as confidential.

You are responsible for:

  • Securing API keys;
  • Monitoring integration access;
  • Disabling compromised credentials.

Unauthorized or abusive API usage may result in suspension.

14. Intellectual Property

The Services, including all software, interfaces, branding, workflows, designs, code, documentation, graphics, and platform content, are owned by CaseWyze or its licensors and protected under intellectual property laws.

Except as expressly permitted, you may not:

  • Copy;
  • Modify;
  • Redistribute;
  • Reverse engineer;
  • Decompile;
  • Create derivative works from;
  • Commercially exploit the Services.

No ownership rights are transferred to users.

15. Feedback

Any suggestions, recommendations, enhancement requests, or feedback submitted to CaseWyze may be used without restriction or compensation.

16. Confidentiality

CaseWyze will use commercially reasonable efforts to maintain confidentiality of Client Data.

However, CaseWyze may disclose information:

  • As required by law;
  • In response to lawful legal process;
  • To protect legal rights;
  • To investigate security incidents or fraud.

Where legally permitted, CaseWyze will attempt to notify affected customers regarding legal requests for data.

17. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

CASEWYZE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:

  • MERCHANTABILITY;
  • FITNESS FOR A PARTICULAR PURPOSE;
  • NON-INFRINGEMENT;
  • DATA ACCURACY;
  • SYSTEM AVAILABILITY;
  • ERROR-FREE OPERATION.

CASEWYZE DOES NOT GUARANTEE:

  • LEGAL COMPLIANCE;
  • EVIDENCE ADMISSIBILITY;
  • INVESTIGATIVE RESULTS;
  • PLATFORM AVAILABILITY;
  • SECURITY AGAINST ALL THREATS.

USE OF THE SERVICES IS AT YOUR SOLE RISK.

18. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CASEWYZE SHALL NOT BE LIABLE FOR:

  • INDIRECT DAMAGES;
  • INCIDENTAL DAMAGES;
  • CONSEQUENTIAL DAMAGES;
  • SPECIAL DAMAGES;
  • LOSS OF PROFITS;
  • LOSS OF DATA;
  • BUSINESS INTERRUPTION;
  • EVIDENCE SPOILATION CLAIMS;
  • DISCOVERY SANCTIONS;
  • LOSS OF CLIENTS;
  • REPUTATIONAL DAMAGES.

CASEWYZE’S TOTAL LIABILITY ARISING FROM ANY CLAIM SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO CASEWYZE DURING THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

19. Indemnification

You agree to defend, indemnify, and hold harmless CaseWyze and its owners, affiliates, employees, contractors, and agents from claims, liabilities, damages, costs, and expenses arising from:

  • Your use of the Services;
  • Your Client Data;
  • Your violation of law;
  • Your violation of these Terms;
  • Your investigative activities;
  • Your misuse of evidence or records.

20. Termination

You may terminate your subscription at any time.

CaseWyze may suspend or terminate accounts for:

  • Violations of these Terms;
  • Non-payment;
  • Illegal conduct;
  • Security threats;
  • Abuse of the Services.

Following termination:

  • Access may be revoked immediately;
  • Data retention periods may apply;
  • Certain data may be deleted permanently.

Unless otherwise required by law, customers are responsible for exporting data prior to termination.

21. Governing Law

These Terms shall be governed by and construed under the laws of the State of Florida, without regard to conflict-of-law principles.

Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Florida, and you consent to jurisdiction and venue therein.

22. Severability

If any provision of these Terms is held unenforceable, the remaining provisions shall remain in full force and effect.

23. Waiver

Failure by CaseWyze to enforce any provision of these Terms shall not constitute a waiver of future enforcement.

24. Changes to Terms

CaseWyze may modify these Terms at any time.

Continued use of the Services after updated Terms become effective constitutes acceptance of the revised Terms.
